The New Hampshire House today reversed itself and passed a bill that bars discrimination on the basis of gender identity. The proposal has been dubbed the "bathroom bill" by its opponents.

If I learned one thing from reading the this article it's the incredible ignorance of the majority of the commenters on the issues of transsexualism.
It's not an issue of homosexuality (most are heterosexual), not an issue of perversion (gender identification is innate), not an issue of confusion (gender identity is imprinted at birth), not an issue of psychology (there is not one documented case of psychology or psychiatry changing one's gender identity), not an issue of lifestyle choice (gender is not a lifestyle nor does one have the ability to choose it)...it IS an innate biophysiological neueral intersex condition of gender.
One would think the citizens of New Hampshire would know that. It's refreshing that at least their legislators do.

reading all these opinions is sorta comical. First of all, you make it sound like the bathrooms dont have stalls, and that these so called predators, are watching our kids pee. Every womens room Ive ever been in has had individual stalls. Secondly, if you go to your nh sexual predator listing you will see that nh has one of the highest listings of sexual predators...and they are NOT transgendered!!!! I have befriended a few transgendered people, and they are intellegent, educated, entertaining, and very caring people I am proud to call Friends. I am more fearful of other people who ARE NOT transgendered, then these few, being around my child.
Not everyone has to agree with others choices being made, however, we should respect all people. Passing judgement on people who dont know ( or, maybe you DO know, and are not aware they may be transgendered...lol) isnt cool.
I am a parent, and I am more concerned about priests, teachers, and others viewed by all of you as "normal'.
A transgendered person...male to female, is NOT going to brasingly walk into a womans room and flaunt themselves....Nor are they gonna walk in looking like a GUY..therefore your children wont be coming out of the rest room saying there is a MAN in there...My gosh people!! I am sure most of you are educated, but truly IGNORANT! I only hope that for your children, cousins, neices or nephews, do not make this choice in life, because I would feel bad if they have to feel such hate from supposed loves ones!

Why is the Union Leader not investigating how our legislators are wasting taxpayer dollars every year as they take baby steps to try and slip all this ridiculous crap under our noses. Civil unions was passed and numerous state agencies had to throw out thousands of dollars in forms, pay to print new ones, pay to have software applications changed to accomodate the new choices and now less than two years later they inch forward a little more and the same thing will now happen again. All this while they talk about layoffs and budget shortfalls. All this money being wasted again and if you read supporters comments they are not done yet. So in another year or so they are going to try and have the term marriage removed. But hey the paper mills will love us as will all the computer folks that charge us hundreds of thousands of dollars to change the systems yet again.
Everyone needs to stop arguing the religious points and tell your legislator that you are not going to put up with their continuing to waste our money because they do not have the backbone to make the change they want. Tell them that we are intelligent enough to see where they want to end up and if they strongly believe in their stance then stand up and be counted. Remind them also that they have gone too far and will be swept right back out in the next couple of elections. In case anyone is wondering I am a FORMER democrat. The party no longer represents my viewpoints. I do believe in a person's freedom to be whomever/whatever they wish, but I do not believe in legislating everyone's personal lives to meet their ideal.

Would this bill be applied in a similar manner to sexual harassment laws? E.g. if I wore a dress to work faced the expected hassling by co-workers, I could bring suit against my employer for failing to provide a workplace where I could freely express whatever sexual identity I felt that day?

Many years ago I was in the Frankfurt airport and looking for a restroom. I finally found a men's room and women's room side by side. Both doors led to the same restroom and set of stalls. People went in, did their business, and left. No problem. So what is the big deal. Are we American's so repressed that we can't differentiate elimination from sex? This bill is poorly worded.
The way it's worded, it defines a protected class based only on their behavior. This is a major problem.
This means that a man can indiscriminately decide to begin using the ladie's room at work, and cannot be fired for that behavior, because the very behavior itself puts him in a protected class.
This is a major can o' worms.
Gender is already a protected class. Choose one or the other. Switch if you want, as long as you're not constantly flip-flopping. We cannot start to define this vague wildcard gender - there is no way to support it, and it's ripe for abuse by those with ill intentions.

I don't think this is imaginary. You said/quoted it right on... the bill "allows individuals to bring actions at the Human Rights Commission when they feel they have been discriminated against on the basis of their sexual identity, or the way they express it, such as with their clothing or makeup."
It is not about bathroom facilities - it is about jobs too. When a Catholic School won't hire someone becasue they had a sex change becasue it goes against the belief of the school - then they can claim discrimination under this law.

I'm similarly concerned that on a list of priorities in legislature today, given the state of the world, that this is even needs to be said, but I do think it is a legitimate bill.
I have a transgendered friend who identifies as a woman, and wants to be in the bathroom with women and trust me you would never know the difference. If women don't want her there, she has to use the men's room, in a dress. That would set off far more flairs, don’t you think. The fact that we have to talk at all about where someone can take care of a natural bodily function is ridiculous.
So Nate in Litchfield, by your logic...if you're in a bar, and there are two bathrooms and this American citizen comes up to you in line in the bathroom - how do you feel about that person doing their business in the stall next to yours if that person is biologically male? What if you found out later she was BIOLOGICALLY female. How has that affected your life in any teeny tiny way? I mean really affected? He peed next to you and left you had no other interaction with you? You didn't even make eye contact. Are you hitting on people in there? Touching each other? No? So what difference did it make for you? Was your pee less satisfying. Did it somehow take away from your peeing experience? I don’t get it.
It's absurd we have to have a law to protect someone on their right to pee. THAT is the insanity here. That we HAVE to have an amendment at all. They wanted to exempt private and religious schools, employers who need women or men in certain positions, churches, rental unit owners, and health care facilities. All the amendments were defeated in order by the roughly the same 70-vote margin.

Not only does this bill not make sense in light of the urgent fiscal policy decisions the Democrat-controlled House should be focusing on, it is a legal quagmire for businesses who will now be forced to allow men who dress up as women use the women’s (and GIRLS’) bathroom facilities. To those who are upset that 4 hours were spent on this, despite it being the last day for the House to pass a budget:
Lay the blame squarely on the Republican reps (the socially arch-conservative faction, not the party as a whole) who used every delay tactic possible: over a dozen amendments; numerous motions to table, postpone, etc; calling a time-consuming roll call on EVERY SINGLE VOTE (knowing full well what the margin would be); unfounded parliamentary disputes; etc.
These are the exact same people who, up until today, dismissed the bill, saying it was not worthy of their time and the budget was more important. Obviously, they give plenty of reason to doubt their sincerity.
The reconsideration was a courtesy to other members because the original vote was so late in the day, over 50 reps had to leave before it was put forth.
Had that faction just let the vote happen at the beginning of the day, it would have taken 10 minutes, the result would have been the same, and they could have gotten down to business with the budget.

Thank you, House Republicans, for wasting over two hours of the legislature's time with frivolous amendments to this bill when there's a state budget to address. It served as a good reminder why Republicans have been relegated to minority status in this state since 2006.

I've been a NH resident all of my life, and I have seen some lackluster periods where our NH house & senate have not measured up to their duties, but these past several years of Democratic rule have bordered on the absurd. To be taking up this bill.......again, shows such an incredible disconnect from reality that you just have to sit back and smack your head.

This is ludicrous. I can't wait for the 1st jerk to be caught in a ladies bathroom and claim he is trans-gender and a woman. Then when arrested he can sue for discrimination "on the basis of their sexual identity". At what point does the law allow you to be classified a woman. Do you have to sign up in advance like a 30 day waiting period or can you decide the second you get caught. If I am a man and want to be woman but still like women sexually, does that make me a trans-lesbian? Or just confused

I think bathrooms need to be based on your human plumbing but hey if you guys want to use the ladies room I will be sure to use the locking FAMILY bathroom that Wal-Mart and Home Depot have.
Sexual predators use EVERY ADVANTAGE THEY CAN and I know it is not fair to my gay lesbian and transgendered friends and I feel badly but hey its the law I will live by it as they should understand the fear that us moms face as it is with bathrooms.

When the right-wing worries about "the budget", they ought to look at their house to see if it is in order. Example, each roll call vote taken in the NH House COSTS a minimum of $1,000. How may were taken just this AM on HB415? The far majority of such roll calls come from the Republicans. Wait. Aren't they the ones who are always whining about the Democrats spending money on frivolous items? Hmmm. Forget party lines, look at the facts!

I would hope the Unionleader in reporting this story will report who was bought off to switch there votes. If they can continously call a vote for a bill that doesn't pass, can we continuously call for a vote if it does pass?

Glad to see that some in the House apparently do not have enough to do outside of bending to lobbyists. This bill is apparently SO important to them that it's already been revived. If only our wonderful state Legislature could put this much effort into cutting spending and fixing the budget they screwed up. Wouldn't it be nice if they could do something useful for EVERYONE in the state and not just certain special interest groups? I know I know, my "hate and intolerance" is showing.
