A burglar, caught in the act by a resident, dropped an unemployment check stub with his name on it as he beat it out a bedroom window, police said.

According to Manchester District Court documents, William Simmons was in the living room of his 557 Pine St. apartment about 10:45 p.m. Thursday when he heard a noise coming from the front bedroom. He thought it was the cat but when he went to find out, he encountered a man hiding behind the door in the bedroom of his girlfriend's daughter.

Simmons yelled to his girlfriend, Debra Lemay, to call police and get him a weapon, according to a police affidavit. The burglar pushed him aside and fled back out the bedroom window.

Police said they found several items outside the window on the front porch along with a daily planner with the word "Teamwork" in bold lettering and the phrase, "together we achieve the extraordinary" on it. Inside the planner was a state unemployment check stub in the name of Michael Noyer with a Union Street address on it.

Officers went to that address but learned Noyer, 45, was living at 456 Pine St., Apt. 7. They found Noyer near there on a bicycle. When he saw them, however, he jumped off the bike, ran inside the building and into a second floor common bathroom, closing the door behind him, according to court papers.

Police forced the door open to find Noyer allegedly trying to hide prescription containers in a hole in the wall.

Police said Noyer had a small ceramic bear on him which Lemay identified as her daughter's.

Noyer was arraigned this morning on burglary, possession of a narcotic, oxycodone, being a felon in possession of a dangerous weapon, falsifying physical evidence and resisting arrest.

Bail was set at $10,000 cash/surety on the felonies and $1,000 personal recognizance on the misdemeanors. A probable cause hearing is Nov. 30 and a trial, Feb. 4.

Noyer asked the judge to give him personal recognizance bail on all the charges, saying when he was previously charged with burglary he had personal recognizance bail and had made all his court appearances.

In August 2004, Noyer was charged with burglarizing the home of Hillsborough County Commissioner Toni Pappas.

I LOVE the details about the day planner. That is some good reporting right there. Thanks UL.

Thanks for those wondering how the "little girl" is doing. She's a 24 year-old who happened to be out with friends the night he broke into her bedroom.

Another reason to not totally believe all that is reported by the newspaper and media.

I think it's absolutely laughable how people criticize the police. If it's change you seek, stop being editorial cowards and monday morning quaterbacks, and fill out an application at the police department.

Ted, get your head out of the sand. We all care about politicians spinning. We need real action on violence. We need real cops.
- Tracey, Manchester

Good God....that's a great one! How stupid can a person be?

At least they got the guy. I watched my neighbors house get robbed on Thursday at noon and called the police. The police showed up at 5pm, in the meantime I took pictures of the robbery. Great response time P.D, what a joke!!!!!
- Brian, Manchester

I think we're going to need a bigger jail....
- Paul, Londonderry

Karen in Keene,
NH's unemployment is less than 8%. Michigan and Ohio and a couple other states with unemploymeent over 14% are in a depression, not NH - thanks to the predominance of non-unionized businesses here that have kept our wage rates in line with the global economy.

Good thing we kept sending this guy the fat unemployment benefit $$$ so he could almost keep up his prescription drug habit. I can't see this moron having pulled off any successful prior burglaries.
- Jim, Manchester

Bail on personal recognizance? Why? So he can burglarize someone else? He admitted to the judge that he burglarized before and was prosecuted for it, apparently he hasn't learned his lesson and is doing it again instead of looking for a job. I'm glad the judge saw fit not to allow him person recognizance this time around.

I wonder if entering this family's home was in his daily planner.
He can use his unemployment check to purchase commissary in prison.
He should be on the nation's most stupid criminals.
- Arnold Wilson, Seattle,WA

Yes he should definitely be punished Im glad the little girl is ok and she was not harmed. I agree with Janit keep all windows and doors locked and be aware of your surroundings pretty scary when we need to be constantly looking over our shoulders.

"And why, again, aren't HOME INVADERS getting 20 to life mandatory as a deterrent?"

A few reasons, Mike. The first of which is the overcrowding of our nation's jails and prisons.

Perhaps more significantly, is that severity of punishment is not an effective deterrent. We would better served by ensuring that perpetrators are caught, arrested, convicted and punished rather than ensuring that punishments are severe. Too often, criminals know that they will likely never get caught. Or if caught, they will get off or work a plea deal. If we ensure that criminals are actually punished, we will find that the severity of punishment, within limits, is not that important.

Mac Wade,

Speaking as a leftist, I do not condone this behavior. If you do the crime, you do the time. And that goes for anyone that does a violent crime.

I also do not favor a police state like you seem to be espousing. A lot of banks have also been robbed by people wearing a tie and carrying a briefcase. And leave us citizens holding the bag.

By the way, "socialist countries" such as Sweden, Norway, Denmark, even Germany and France seem to have a lot less violent crime and perhaps more personal freedoms than this country. And a lot less debt. It cost a lot of money supporting the military-industrial complex. Read DDE's farewell speech to Congress for enlightenment. (no socialist, he)

As Mark Twain once said, "Better to be thought of a fool, than to open your mouth and remove all doubt"

I truly beleive that we are in a depression , not a recession, Theft has increased as well as unemployment and the banks are failing. My granparents talked a lot about theft during the great depresson, People tried to steal gas out of his tractor and would come to his house for food. These are desparate times

Today's episode of stupid criminals...

I'd like to know what was in his daily planner.
Let me guess: wake up, have a few beers, get unemployment check, break into a house, get caught, find place to stay for the winter w/ amenities (3 hots and a cot).

Of course, on the MPD blog, they made it look like they were doing some serious detective work. Like using powdered donuts for fingerprint analysis. And the home owner to show them where the address was on the check and directions to get there.
- Bob in Manchester, Manchester

Hope the daughter is OK and this didn't traumatize her. Looks like everyone better keep their windows locked as well as their doors. What is this world coming to. God bless and watch over us.
- Janit, Manchester

Ah...just the type of people the Leftists love to coddle with their government dependence scheme. Nothing quite like enabling criminals to milk the system and continuing NH down the same road traveled by rest of "nanny states" here in the northeast.
- Mac Wade, Newmarket

Dallas- Your comment is small mindness. This has nothing to do with your issue with Guinta and the PD.
- Ted, Manchester

Buh Bye hamburglar. That is scary. What an odd list of charges.
- E, Manchester

Guess he won't be needing those unemployment checks anymore!
- TJ, Concord

This is another violent crime, stopped by Dad. Guinta and Chief Mirror don't want it to look that way. This is why they want THEIR crime analyst.
- Dallas, Manchester

Bet he'll still get his unemployment, just watch.

And why, again, aren't HOME INVADERS getting 20 to life mandatory as a deterrent?
