The defendant, Jason Wilmot, appeals his convictions, following a jury trial in Superior Court (Lynn, C.J.), on two counts of first-degree assault for recklessly causing serious bodily injury to a person under thirteen years of age. The jury could have found the following facts. The victim was between two and three months old when his ribs and skull were fractured and he was shaken, which caused his brain to bleed. When the baby suffered these injuries, the defendant lived with the baby and the baby's mother.
