Rapist convicted in 1998 asks to be released from prison
MANCHESTER — A former city man who admitted to invading West Side homes in 1998 — robbing several residents and raping a woman as her 3-year-old slept in a bed beside her — asked a Hillsborough County Superior Court judge to vacate his sentence this week.
Bradley Winbush, 36, said he was under the impression he would serve only 22 years when he pleaded guilty in 1999 to three counts of burglary, five robbery counts and two rape charges.
Sentencing documents list his prison sentence as 22 to 62 years, Assistant Hillsborough County Attorney Jennifer Sandoval said Wednesday. But Winbush's acknowledgment and waiver of rights form filled out by defense attorney Barbara Keshen list his sentence as 22 to 44 years, she added.
Winbush told the court Tuesday he was accustomed to New York and Massachusetts' sentencing systems which do not necessarily give sentences in ranges, according to Sandoval.
Keshen could not be reached for comment Wednesday. According to Sandoval, Keshen said she believed Winbush's sentence was 22 to 44 years, but John Weld, who prosecuted the case, said Winbush was committed to 22 to 62 years.
No existing recording of the 1999 sentencing hearing exists since they are routinely destroyed after 10 years.
Judge David Garfunkel took the matter under advisement.
