NHSUPCO - Regina Mbahaba v. Thomas Morgan d/ba/ Property Management Services <<< Affirmed in part, reversed in part, and remanded.
To be sure, the defendant correctly argues that he had every right to establish a new LLC and to transfer the original LLC's clients to it. However, that the defendant made this “fresh start” when his company remained a party to this case, could permit a finding that the limited-liability identity was used to promote an injustice upon the plaintiff. Thus, based upon our review of the depositions and other evidence in the light most favorable to the plaintiff, we cannot conclude that the defendant is entitled to judgment as a matter of law. Accordingly, the trial court erred in granting summary judgment.

United States Court of Appeals,First Circuit - RANDALL v. LACONIA <<< In this case the court finds the city can't be held accountable for failing to disclose lead paint in home it sold.
Federal law requires home sellers to alert potential home buyers to the presence of lead-based paint hazards. The City of Laconia, New Hampshire sidestepped this requirement when it sold Jameson Randall his house. Some years later, after learning that lead-based paint was present in his home, Randall filed suit. The sole question is whether his lawsuit is time-barred. We agree with the district court that it is, and therefore affirm.

1st Circuit vacates dismissal of fraudulent federal grant application for Alzheimer's research against Brigham and Women's Hospital and Harvard Medical School
After careful review of the record, we conclude that the district court abused its discretion by excluding or failing to consider certain expert testimony. It then committed an error of law by failing to consider statements of the parties and experts in a manner required by the summary judgment standard. MORE
