Four men arrested for solicitation of prostitution arraigned
Four men arrested within an hour’s time for solicitation of prostitution in the area of Manchester and Union streets July 3 were scheduled for arraignment Friday in Circuit Court-Manchester District Division.
Two men showed up and pleaded innocent, one failed to appear and one appeared, but sought to have the charge dismissed, claiming he is a juvenile.
Fred Baldinelli, 50, of 645 Rimmon St., and Keith Cyr, 41, of 907 Hayward St., pleaded innocent and bail was continued at $1,000 personal recognizance, with trial for both men set for Oct. 25.
Anthony Huertas, 32, of 23 Stone St., Dracut, Mass., failed to appear and a bench warrant was issued for his arrest, with bail set at $350 cash-only.
The fourth man, who had provided police and a bail commissioner with a birth date of June 28, 1994, which made him 18, and signed paperwork affirming the truth of his statements, showed up in court Friday claiming to be a juvenile and seeking to have the charge dismissed.
Police prosecutor Lt. Ron Mello said the accused brought to court a Guatemalan birth certificate, showing a birth date of Feb. 15, 1996, but no photo ID.
Public defender Sara Rothman asked Judge Gregory Michael to dismiss the prostitution complaint on the spot. Michael wouldn’t do that, but set a hearing for Aug. 3 on a motion to dismiss.
Selling handbags
A Derry woman charged with deceptive business practices pleaded innocent Friday in Circuit Court-Manchester District Division and trial was set for Oct. 25.
Bonnie A. Usher, 44, of 13 Blackberry Road, is accused of selling what she represented as designer handbags out of her car outside a city drugstore July 9.
Usher told Judge Gregory Michael it’s all a mistake, that she has a license to carry items in her vehicle for her consignment shop. “The charges will be dropped. It was a false arrest,” said Usher.
Bail was continued at $5,000 personal recognizance.
Says drugs prescribed
A man arrested twice this month on disorderly conduct charges was arraigned Friday in Circuit Court-Manchester District Division on a felony charge of possession of a narcotic.
Patrick McNamara, 26, of 140 Central St., told Judge Gregory Michael that the drug in question is prescribed to him for seizures and that two other drugs he had with him were antibiotics prescribed for an eye problem.
Police prosecutor Lt. Ron Mello said McNamara did not produce prescriptions for the drugs and they were not in a proper container.
Mello said McNamara was released on $2,000 personal recognizance bail July 11 on a disorderly conduct charge and was in court Monday 16 on a new disorderly conduct charge and a contempt of court charge, because he was out on bail at the time of the new charge. He was released that day on another $2,000 personal recognizance bail.
As a result, said Mello, he was seeking $2,000 cash/surety bail on the new drug and contempt charges. But Judge Gregory Michael again set a $2,000 personal recognizance bail for McNamara, urging him to stay out of trouble. “You think you can do that,” asked Michael.
A probable cause hearing on the felony was set for Aug. 2 and trial on the contempt charge was set for Sept. 25, the same day as trial on the three earlier misdemeanor charges.
Alcohol-related
Circuit Court-Manchester District Division Judge Gregory Michael Friday fined a city man $1,000, suspended for one year of good behavior, with no alcohol-related offenses, on negotiated pleas to reduced criminal trespass and public urination charges stemming from alcohol use in a city park.
Rodney Yancey, 32, of 141 Beech St., had been held on $3,000 cash/surety bail since his arraignment July 10 on the charges originally brought as misdemeanors.
A police prosecutor had obtained the cash/surety bail at the July 10 arraignment, citing Yancey’s 2011 and 2012 convictions in Henniker and Manchester on charges including hindering apprehension, assault, theft by unauthorized taking, criminal mischief and resisting arrest.
Prostitution arrests
Manchester police undercover officers arrested two women on prostitution charges Thursday night. Jessica Banville, 28, of 452 Pine St., was arrested in the area of Union and Merrimack streets about 9:30 p.m. after she allegedly agreed to perform a sex act in exchange for money.
A few minutes later, at Beech and Hanover streets, Macy LaPlante, 23, of 461 Beech St., was arrested on the same charge.
Both women are scheduled for arraignment Aug. 3 in Circuit Court-Manchester District Division.
