Wilton man indicted on charges related to shooting
MILFORD — Wilton resident Nathan O’Brien has been indicted by a Hillsborough County grand jury on five felony charges related to a shooting in Milford in April.
The charges including three counts of reckless conduct, one count of criminal threatening and one count of falsifying physical evidence — all Class B felonies — against O’Brien who lives at 47 Wilson Hill Road in Wilton.
The incident leading to the charges occurred on April 23 at a business on Hayden Lane in Milford owned by O’Brien’s father. O’Brien, 23, was working when the alleged victim, Thomas Cuddy of Amherst, showed up at the site, according to court documents.
Cuddy and O’Brien were allegedly involved in an ongoing dispute, according to O’Brien’s father, Martin O’Brien, and Cuddy had been told to stay away from the property. However, when he arrived on site, the two men reportedly began arguing.
During the altercation, O’Brien allegedly pulled a Glock 9mm semi-automatic handgun on Cuddy, pointed it at him and threatened to kill him, according to court documents.
He then fired the gun near Cuddy’s head, and the bullet hit Cuddy’s Dodge Ram pick-up.
O’Brien reportedly hid the gun under some leaves and pine needles near a locked trailer and fled the scene in his own vehicle as police were called in.
They were able to locate him and allegedly found a 9mm round in O’Brien’s chest pocket. O’Brien, according to court documents, said that Cuddy had headbutted him, and police noted in an affidavit that O’Brien’s nose was swollen and bleeding.
O’Brien, who has no previous criminal record, was arrested and charged with four felonies including reckless conduct with a firearm, criminal threatening, falsification of physical evidence, and drug possession.
The drug possession charge was dropped, but the grand jury indicted him on three reckless conduct charges for pointing the gun at Cuddy and firing it near him.
O’Brien was released on April 26 on $50,000 corporate surety bail. The conditions of O’Brien’s bail have him on a strict curfew from 7 a.m. to 7 p.m. to allow him to work. He is not to have any contact with Cuddy.
