Relief for victims of mortgage misconduct

Homeowners who believe they were financially harmed due to bank misconduct during the mortgage foreclosure process can apply for a free, independent foreclosure review, according to an announcement Friday by New Hampshire Attorney General Michael A. Delaney and Senior Policy Analyst Ana Patricia Muñoz of the Federal Reserve Bank of Boston.

Applicants must show:

-- The property securing the loan was the borrower’s primary residence.

-- The mortgage was in the foreclosure process (initiated, pending or completed) at any time between Jan. 1, 2009 and Dec. 31, 2010.

-- The mortgage was serviced by a participating mortgage servicer (listed below).

If the review finds that financial injury occurred as a result of bank misconduct, the borrower may receive remediation such as lump-sum payments, suspension or rescission of a foreclosure, a loan modification or other loss mitigation assistance, correction of credit reports, or correction of deficiency amounts and records. Lump-sum payments can range from $500 to $125,000 plus equity.

Homeowners meeting the initial eligibility criteria should have been mailed notification letters with an enclosed Request for Review Form before the end of 2011. The Request for Review Form can be returned in the prepaid envelope provided or completed online at www.independentforeclosurereview.com. The Request for Review Form must be postmarked or submitted online no later than Dec. 31.

Borrowers seeking a new form by mail, who have questions, or who need help completing the form, should call the administrator, Rust Consulting, at (888) 952-9105, Monday through Friday, 8 a.m. to 10 p.m. or Saturday, 8 a.m. to 5 p.m.

The list of participating servicers includes: America’s Servicing Co.; Aurora Loan Services; BAC Home Loans Servicing; Bank of America Beneficial; Chase; Citibank; CitiFinancial; CitiMortgage; Countrywide; EMC; EverBank/EverHome Mortgage Co.; Financial Freedom; GMAC Mortgage; HFC HSBC; IndyMac Mortgage Services; MetLife Bank; National City Mortgage; PNC Mortgage; Sovereign Bank; SunTrust Mortgage; U.S. Bank; Wachovia Mortgage; Washington Mutual (WaMu); Wells Fargo Bank, N.A.; Wilshire Credit Corp.
