MANCHESTER — A woman who is facing negligent homicide and manslaughter charges in the drowning of her baby boy was arrested Friday for driving with a suspended license, her second arrest in the last two weeks.
Melissa Gutierrez, 26, was pulled over up around 3 a.m. Friday after officers noticed she had failed to signal a turn, then remained parked at a stop sign for about five minutes at the intersection of Cedar and Pine streets. According to court documents, officers ran her name and found she was convicted of driving on a suspended license in February 2009. She was taken into custody and jailed on a charge of driving with a suspended license, second violation.
Court documents showed she was released later Friday. She did not return a request for comment left Friday.
Gutierrez also faces a charge of theft by unauthorized taking from an incident Sept. 14 at a Rite Aid on Elm St. and is scheduled for a court date Oct. 5.
Matthew Pennington, a public defender who represented Gutierrez in the shoplifting case, declined to comment when asked about Gutierrez's latest arrest or any of her pending cases.
Assistant Hillsborough County Attorney David Tencza said his office filed a motion to have her bail revoked after learning of the shoplifting arrest. The motion was still pending as of Friday and it was not immediately clear if or how her traffic stop could affect the motion.
Tencza said he was limited by a court gag order on what he could say about the negligent homicide and manslaughter charges Gutierrez still faces in the death of her 8-month-old son Christian Ntapalis, who drowned Aug. 25, 2011 in a bathtub.
