An Allenstown man was back in Circuit Court-Manchester District Division Friday, this time for arraignment on felony theft by deception and receiving stolen property charges from alleged incidents Sept. 6.

New bail of $10,000 cash/surety was set for Travis Beach, 28, of 14 Elmer Ave., who was arraigned Thursday and Oct. 4 on similar charges. Beach is being held on cash/surety bail on two earlier sets of charges.

Because no plea can be entered in Circuit Court to a felony charge, a probable cause hearing was set for Oct. 25. Beach has probable cause hearings scheduled Oct. 18 on earlier felony charges and a trial on misdemeanors set for Jan. 15, 2013.

Pawnshop ordinance

A man who said he was sentenced Wednesday on other charges was arraigned Friday in Circuit Court-Manchester District Division on new felony charges of theft by deception and receiving stolen property.

Because no plea can be entered to a felony in Circuit Court, a probable cause hearing was set Oct. 25 for Scott Fisher, 33, of 59 Hillcrest Ave., who was arrested on warrants.

A condition of his $10,000 cash/surety bail include not going to the Cash for Gold store where he allegedly sold items.

Police prosecutor Capt. Robert Cunha said the new pawnshop ordinance, which requires shops to submit digital information about pawned/sold items and the person selling the item to LeadsOnline, and the 30-day hold on reselling, played a part in the charges against Fisher.

Lawyer pleads for release

The lawyer for a woman accused of stalking and violating bail conditions by calling her ex-boyfriend Oct. 7 argued in Circuit Court-Manchester District Division Friday that she should be released on personal recognizance bail. Attorney William Schultz said Lora Hawkins, 25, of Chelmsford, Mass., has two witnesses who accompanied her to Manchester in July to visit her child at the man's apartment on Elm Street and will testify that she never touched the ex-boyfriend.

Schultz said the man accused Hawkins of slapping him that day. He said Hawkins went to the police station with her child in her arms and the ex-boyfriend followed, making the accusation. Schultz said Hawkins was charged, but after she was released on personal recognizance bail, the alleged victim told police Hawkins stalked him by calling him.

Schultz said when Hawkins learned about the stalking warrant, she turned herself in and Judge Gregory Michael set personal recognizance bail for her Thursday. It was at that hearing, said Schultz, that she learned about new charges of criminal threatening and stalking.

Schultz said that, with the Oct. 17 assault trial date approaching, the ex-boyfriend wasn't happy with how things were going and called police to say that Hawkins had called and threatened him Oct. 7. That prompted new charges of threatening and stalking and resulted in the filing by police prosecutors of a bail revocation motion that requires the defendant to be held for a hearing on the next court date.

Schultz said Hawkins had turned herself in and asked that she be released on personal recognizance bail again.

But police prosecutor Capt. Robert Cunha would not withdraw the motion, so Judge William Lyons said Hawkins must be held over the weekend, with a bail revocation hearing set for Monday. Trial on the new charges was set for Nov. 13.

Accused of texting

Brayan Rico, 20, of 381 Myrtle St., is being held until a bail revocation hearing Monday in Circuit Court-Manchester District Division.

Rico is accused of texting a woman Thursday, in violation of bail conditions on a pending simple assault charge. Trial on the stalking charge was set for the same date, Oct. 29.
