Manchester man, in court, maintains he was assaulted

MANCHESTER — A city man whose wife was hospitalized for her injuries was arraigned Monday in Circuit Court-Manchester District Division on a felony second-degree assault charge.

With the assistance of a telephone translation service, Padam Siwakoti, 32, of 159 Concord St., who is from Nepal, heard the charge in his language and had his responses and comments translated into English.

Siwakoti is accused of punching and kicking his wife about the face and head, causing her to lose consciousness. After she was transported to the hospital, it was determined that she had sustained a fractured left orbital bone and possible bleeding on the brain,

Siwakoti protested the charge, pulling off the orange shirt worn by detainees to show off what he said were wounds inflicted on him — bruises and scratches.

Judge William Lyons told Siwakoti that that information was for the trial, but the session Monday was to advise him of the charge against him and set bail and further court dates.

The police prosecutor requested $10,000 cash/surety bail. Through the telephone translation service, Siwakoti said: “I'm not able to pay $10,000,” but Lyons set bail at the amount requested by the prosecutor.

A probable cause hearing on the felony charge was set for Nov. 13.

Shoved from moving car

A police officer dispatched to the scene of a disconnected 911 call in the area of Lake and Barry avenues early Sunday morning saw a car make a turn onto Barry Avenue, the passenger door open and a woman fall out and roll up against a building on the corner.

Officer Drew Fleming said the woman got up and ran to him, trying to hide behind him as the driver chased after her and grabbed her arm.

The officer separated the woman and the driver, identified as Alexis Nieves, 27, of 312 Spruce St.

The woman told Fleming that she and Nieves had an argument in the car and he punched and slapped her, grabbed the phone from her when she called for help and then pushed her out of the car. The woman had injuries to her knees, legs and elbow.

Nieves, who police said struggled with officers seeking to handcuff him, was arraigned Monday in Circuit Court-Manchester District Division on a felony charge of reckless conduct and misdemeanor charges of simple assault, resisting arrest, obstructing the report of a crime and second offense operating a motor vehicle without a license.

Nieves could enter no plea to the felony charge, so a probable cause hearing was set for Nov. 13. Trial was set for Jan. 7, 2013, on the misdemeanor charges. Bail is $25,000 cash/surety with conditions barring contact with the woman or going to her residence.

Traffic stop proves costly

A man stopped Friday evening for running a stop sign at Putnam and Main streets ended up being charged in Circuit Court-Manchester District Division Monday with felony possession of a controlled drug with intent to distribute.

After officer Tom Whelan pulled over Timothy Deichler, 33, of 86 Wire Road, Merrimack, for ignoring the stop sign, further investigation resulted in the discovery of a black box inside the vehicle that contained five bags of suspected morphine totaling about 3.5 grams. Also recovered were scales, straws, syringes and other drug paraphernalia and what police described as a “significant amount of cash.”

Deichler served 3½ years in state prison in connection with the 1995 death of his 6-week-old daughter Amanda Lynn Deichler. Then 16, he admitted to bouncing the infant on the bed, causing her head to hit the headboard twice, resulting in her death.

About five years ago, he was arrested for allegedly punching a pregnant woman in the face and kicking her in the stomach during an incident at their Wire Road home. A week after the incident, the woman delivered a stillborn baby, but a medical examiner's report indicated no trauma to the baby.

The mother did not want Deichler prosecuted for assault and the charges were later dropped by prosecutors.

Accused of sister assault

Tek Bahadur Dahal, 27, of 550 Lincoln St., could enter no plea Monday in Circuit Court-Manchester District Division to a felony charge of burglary that alleges he entered his sister's apartment and said: “I'm going to kill you and bury you and no one will find you.”

Speaking with the assistance of a telephone translation service, Dahal, who is from Nepal, pleaded innocent to two simple assault charges that alleged he punched his sister and grabbed her by the shoulders. He said he didn't hit her, she assaulted him.

He protested a proposed $5,000 cash/surety bail and Judge William Lyons set bail at $3,000 cash/surety, with conditions that include no contact with his sister and not going to her residence.

A probable cause hearing on the felony was set for Nov. 13 and trial on the misdemeanors was set for Jan. 28, 2013.

Ran over a no-parking sign

Nicholas Rowe, 28, of 77 High St., Goffstown, pleaded innocent Monday in Circuit Court-Manchester District Division to misdemeanor charges of leaving the scene of an accident, false report of an accident and driving while intoxicated.

A police officer responding to a reported accident Saturday night at Wilson and Manchester streets saw Rowe attempting to walk away from the scene. Rowe denied being involved in the incident in which a truck traveling west on Manchester Street, near Wilson, veered off the road and onto the sidewalk, hitting a no-parking sign.

Witnesses said Rowe attempted to drive away, but the vehicle was stuck on the sign. He was eventually able to free the vehicle and parked it nearby. Area residents approached him and took his keys, trying to detain him for police.

The responding officer observed that Rowe appeared to be impaired by alcohol.

Bail was set at $1,000 cash/surety, with conditions that include no alcohol consumption. Trial was set for Jan. 22, 2013.

Knife threat alleged

Michael Lemire, 36, of 455 Pine St., could enter no plea Monday in Circuit Court-Manchester District Division to a felony charge of armed robbery that alleges he held a knife to the throat of a woman and demanded money.

Lemire pleaded innocent to a charge of false imprisonment that alleges he used the knife to prevent the woman from leaving an apartment.

A probable cause hearing on the felony was set for Nov. 13 and trial on the misdemeanor was set for Jan. 7, 2013. Bail was set at $7,500 cash/surety, with conditions barring contact with the alleged victim.
