Two men in custody on charges after shooting
NASHUA - Two potential witnesses to Sunday's shooting on Salvail Court are in custody, but investigators said Tuesday that they are not currently suspects.
Authorities are still not releasing the name of the man who was shot Sunday night and remains hospitalized, nor are they commenting on his condition. Peter Hinckley, assistant attorney general, said the two potential witnesses, Daniel DeGrace, 31, and Benjamin Mayberry, 30, were arrested on Monday in Vermont near the Canadian border.
"They both have federal gun charges they are facing right now," said Hinckley, adding they are both still in custody after being found by U.S. Border Patrol agents in Newport, Vt.
Hinckley would not elaborate on the federal charges, saying his agency is not handling that matter. DeGrace is also facing a charge of falsifying evidence in New Hampshire, which Hinckley confirmed is related to Sunday's shooting incident in Nashua, although he declined to provide more specifics.
"It is an open investigation," he stressed, not commenting on whether the two men are cooperating with authorities. They are still potential witnesses at this point, and not considered suspects, added Hinckley.
Although he would not say whether police are searching for a shooter at this time, he said authorities have no reason to believe the public is in any danger.
Investigators were hoping to release the identity of the victim on Tuesday, but Hinckley said at least one or two family members have still not been notified of the shooting. Police spent several hours on Monday collecting potential evidence outside of 1 Salvail Court, taking items out of several nearby garage bins and photographing evidence markers in the side parking lot area of the apartment building. Several occupants of the apartment building were evacuated while police canvassed the scene, which is located across from BAE Systems on Canal Street.
Investigators remain tight-lipped about the specifics of the case, refusing to comment on whether the shooting took place inside or outside of the apartment.
Police have not said what type of gun was used in the shooting, or whether it has been located.
