Walmart case appealed to state Supreme Court
MANCHESTER - A second court case challenging the location of a Walmart Supercenter on Gold Street has been appealed to the New Hampshire Supreme Court.
On Dec. 3, Hannaford Bros. supermarkets and Victory Distributors appealed a lower court ruling that upheld a decision by Manchester aldermen to gate the industrial end of Gold Street. The gating of Gold Street was sought by Walmart as part of its plans to construct a Supercenter at the Gold Street location of the shuttered Associated Grocers of New England warehouse.
Hannaford and Victory have already appealed a separate suit relating to the project - approval of Walmart plans by the Manchester Planning Board. That case has been fully briefed, but justices have yet to hear oral arguments in the case.
