BRENTWOOD - A Salem man who allegedly gathered up his friends and went to the home of a man who was taunting him on Facebook has struck a plea agreement that could get him a suspended jail sentence, according to documents filed by his lawyer.
Shane Delandy, 21, will plead guilty to misdemeanor criminal trespass and criminal threatening for allegedly going to the Salem home of Michael Peters on April 3. If a judge approves the agreement, prosecutors will drop a felony burglary charge that could have landed Delandy in state prison for up to 3½ to 7 years.
A plea and sentencing hearing is scheduled for Jan. 30 in Rockingham County Superior Court.
Delandy was among three men indicted on felony burglary charges, punishable by state prison time, for storming Peters' home on Independence Drive in Salem, according to prosecutors.
His plea deal would result in a pair of suspended, year-long jail sentences. Delandy will have to remain on good behavior for two years and perform 50 hours of community service, according to the terms of the agreement.
Police say Delandy decided to round up about a half-dozen friends on the night of April 3 and head to Peters' home after receiving taunting messages from him on Facebook.
"The alleged victim (Peters) was taunting one of the suspects in the home invasion, making references to drug sales, being 'a rat' and calling him other names," Deputy Police Chief Shawn Patten said in an earlier interview.
Rui Conde, 27, and another man allegedly forced their way into the house by smashing the front door and windows of the home with baseball bats, according to police.
Conde recently received a suspended 1- to 3-year prison sentence after he pleaded guilty to felony burglary, according to court records.
Peters grabbed a knife from his kitchen and stabbed Conde during the melee and a fight eventually spilled out onto the front lawn, police said. Conde was treated for stab wounds at Lawrence General Hospital after the fight. A third man, Michael Fantasia, 22, of Salem is scheduled for trial later this year on a felony burglary charge for his alleged role in the break-in.
