BRENTWOOD - A convicted drug dealer indicted for impersonating a lawyer while he was in jail so he could call another inmate in Merrimack County may soon be free on bail once he completes his latest state prison sentence.
John Bouraphael, 33, of Danville was arraigned Wednesday morning on identity fraud charges brought against him and his girlfriend earlier this month in Rockingham County Superior Court.
Judge N. William Delker set bail at $10,000 cash for Bouraphael after hearing arguments by his defense lawyer and prosecutors on Wednesday morning.
Bouraphael's bid for freedom comes as he nears the end of his state prison sentence on felony drug and weapons charges. He pleaded guilty in August to sale of a controlled drug, possession of a controlled drug with intent to distribute and felon in possession of a weapon.
Sheriff's deputies arrested Bouraphael last Dec. 21 in connection with his marijuana business, and seized roughly $410,000 from a safety deposit box he kept at a local bank. He could be paroled from the state prison on April 12, according to prison records. Bouraphael was being held at the Rockingham County jail when he allegedly impersonated public defender Anthony Naro on June 1 by using the attorney's bar ID number.
Merrimack County correctional officers believed it was Naro on the line, wanting to speak to his client Jacob Palo, 36, of Concord, according to prosecutors.
Bouraphael called Palo to talk about their enterprise of strong-arming fellow inmates out of their canteen goods while the two were being held in Rockingham County, prosecutors said.
Rockingham County Corrections Lt. Dave Consentino discovered the alleged phone ruse while reviewing recordings of outgoing jail calls. The county sheriff's department was called in to investigate.
A grand jury indicted Bouraphael and his girlfriend, Shayna Provencal, 24, of Andover, Mass. earlier this month.
Provencal will be arraigned on Jan. 31 on a charge of accomplice to identity fraud for allegedly setting up the three-way call between her jailed boyfriend and the Merrimack County jail. Bouraphael had requested work release back in December but that issue was deemed moot on Wednesday in light of the latest charges that were brought by a grand jury, according to Assistant County Attorney Michael Zaino.
