DOVER - Prosecutors are once again seeking an extension on their deadline for seeking indictment against a murder suspect.
Seth J. Mazzaglia, 30, has been in police custody since Oct. 13 when he was charged with second-degree murder.
Police allege he strangled and/or suffocated University of New Hampshire sophomore Elizabeth "Lizzi" Marriott, 19, of Westborough, Mass., in his Dover apartment the night of Oct. 9. Police spent weeks searching for Marriott's body in the waters around Peirce Island in Portsmouth based on "credible information," but it has never been recovered.
On Christmas Eve, Mazzaglia's girlfriend at the time of the alleged murder, Kathryn McDonough, 19, of Portsmouth was arrested and charged with providing false information to police. She has since posted bail and is awaiting indictment out of Rockingham County Superior Court.
In a motion filed in Strafford County Superior Court on Jan. 29, Peter Hinckley with the New Hampshire Attorney General's Office said they need more time to talk to potential witnesses and complete "certain investigative steps" before seeking indictment against Mazzaglia.
It is the second time the state has filed a motion seeking an extension beyond the 90-day deadline for indictment. A judge granted a previous request on Jan. 2 permitting an extension through the end of February.
Now the state wants until the April grand jury term to present its case.
Hinckley said since the filing of the last request in December, additional interviews have been conducted and an attempt was made to begin presenting the grand jury with information.
Hinckley said although the state has received results of various forensic tests, they are still waiting for certain tests they believe will provide "additional pertinent information."
According to the motion the state has begun to provide Mazzaglia's defense team with discovery, including over 1,200 pages of police reports, lab reports, witness interviews, transcripts and other documents, as well as a dozen disks containing audio and digital data.
All documents related to Mazzaglia's arrest have been kept under seal per a judge's order pending indictment.
As of Wednesday afternoon a judge had not yet ruled on the state's motion.
