MILFORD - Two men have been indicted on a charge of armed robbery after allegedly beating and robbing a man in the Shaw's Supermarket parking lot on Nashua Street in December.
A grand jury at Hillsborough County Superior Court's Southern Division has indicted Jason Smolinsky, 30, of 10 Tricnit Road in New Ipswich and Jeffery Pollock, 43, of 6 Orange Street in Milford on one count each of felony armed robbery for their attack on victim Kenneth Martel.
According to Capt. Chris Nervik of the Milford Police Department, on Dec. 4 at around 4:20 p.m. police received a report of a fight and possible stabbing in a black Lincoln MKX in the parking lot of Shaw's Supermarket. While officers responded to the shopping plaza, another call came in at the same time reporting a suspicious man in the area of Foster Road. The man was allegedly going door to door asking for water. Officers located the man who was determined to be Kenneth Martel of Milford.
Nervik said that Martel told police that he has just been robbed, beaten, and kicked out of a vehicle on Foster Road, a few miles from the supermarket. While speaking with Martel, officers found that Martel was in possession of heroin and a hypodermic needle. He was subsequently arrested for possession of a controlled drug and reckless conduct, both class B felonies.
In the meantime, Martel's report was investigated and police determined that Smolinsky and Pollock were behind the attack on Martel and warrants were issued for their arrest.
Police arrested Smolinsky and Pollock on Dec. 19. Smolinsky, a convicted felon, has been held on $75,000 cash/surety bail since the arrest, and Pollock has been jailed on $50,000 cash/surety as well.
Though Pollock was originally charged with armed robbery, criminal threatening, and being a convicted felon in possession of a firearm, he and Smolinsky were only indicted on the armed robbery charges.
Martel is awaiting possible indictment on the felony drug possession charges after probable cause was found during a hearing at the 9th Circuit Court in Milford on Jan. 9, according to prosecutor Michael McCall. Martel is also facing trial on another drug possession indictment stemming from an Oct. 4, 2012, arrest.
