Manchester man disputes charges, accuses victim of lying

MANCHESTER - A man accused of punching his girlfriend, then throwing and breaking things and punching a hole in the wall at his residence said Tuesday in Circuit Court-Manchester District Division that the alleged victim lied.

Michael Marchetti, 26, of 307 Manchester St., told Judge William Lyons he did punch a hole in the wall, but that was a while ago.

Marchetti also protested a felony narcotic (heroin) possession charge, saying: "The cops didn't find any drugs on me."

Marchetti insisted he was trying to leave and go to his mother's residence, but the alleged victim got there first so she could claim he was following her.

Marchetti was also charged with contempt of court, because he was out on personal recognizance bail on a charge of conduct after an accident.

Lyons set bail at $8,000 cash/surety, with conditions barring contact with the alleged victim and barring Marchetti from going to the woman's residence.

A probable cause hearing on the felony was set for March 26 and trial on the misdemeanors was set for May 7, the same day as the earlier misdemeanor charge.

Cash bail stands

Zachary Frost, 19, of 1632 New Boston Road, Francestown, Tuesday asked for personal recognizance bail at his arraignment in Circuit Court-Manchester District Division on two charges of credit card fraud, one of attempted credit card fraud and one of unsworn falsification.

Frost is accused of using a Discover credit card he knew to be lost or stolen to buy groceries at Market Basket and Stop and Shop and to attempt to get a $200 Visa gift card July 9, 2012, and of giving police the name of his younger brother and signing the Manchester Police Department juvenile rights form with his brother's name Aug. 8, 2012.

Frost was released on $1,000 personal recognizance bail, but when he failed to appear in Circuit Court for arraignment Aug. 24, 2012, an electronic bench warrant was issued with a $500 cash bail. Frost was arrested in Carroll County on the warrant.

Frost asked Judge William Lyons for $5,000 personal recognizance bail, instead of the $500 cash bail, but Lyons said Frost's failure to appear for arraignment, the multiple charges and his deceptive behavior precluded personal recognizance bail. Trial was set for April 17.

Possession with intent

Robson Souza, 28, of 275 Lake Ave., could enter no plea Tuesday in Circuit Court-Manchester District Division to a felony charge of possession of a narcotic (heroin) with intent to sell.

Bail was set at $20,000 cash/surety and a probable cause hearing was set for March 26.

Accused of assaulting ex

Helen Johannes, 27, of 10 Emerson Way, Salem, pleaded innocent Tuesday in Circuit Court-Manchester District Division to misdemeanor charges of simple assault and reckless conduct.

Johannes is accused of punching her ex-boyfriend in the head at least four times while he was holding their son.

Bail was continued at $500 cash/surety, with conditions barring contact with the alleged victim, and trial was set for May 20.
