Federal appeals court sides with Entergy in Vermont Yankee case

Entergy, which owns the plant, sued the state of Vermont in 2011, claiming the state Legislature overstepped its authority by passing bills aimed at assessing safety at the 600-megawatt boiling-water reactor. This, Entergy argued, pre-empted both the Nuclear Regulatory Commission’s jurisdiction in the process and the federal Atomic Energy Act.
