N.Y. man will not be charged with hitting pedestrian in Epping

EPPING — A New York doctor whose vehicle struck a man when he and an 11-year-old boy tried to walk across Route 125 Saturday night will not face charges, police said.

David Spingarn, 60, of Saratoga Springs, N.Y., was traveling north on Route 125 around 7 p.m. when he hit 36-year-old Robert Whiteside.Epping Officer Jonathan Swift said police believe Whiteside was intoxicated when he attempted to cross the highway and was struck near the entrance to McDonald's.

Swift said Spingarn wasn't able to see Whiteside, who landed in the middle of the highway after he was struck.

Spingarn immediately stopped and rushed over to help Whiteside until rescue personnel arrived.

Spingarn practices family medicine, according to the website for Saratoga Hospital in Saratoga Springs, N.Y.

The boy wasn't injured.
Whiteside, whose last known address was in Nashua, was taken to Elliot Hospital in Manchester; he was listed in fair condition Sunday afternoon, a hospital spokesman said. The extent of his injuries is not known.
In the moments before the accident, Whiteside was seen with the boy walking around in the front parking lot of McDonald's. Shortly after 6:30 p.m., the two walked across Route 125 and into the parking lot after their vehicle broke down on the northbound side of the highway, police said.
While in the parking lot, witnesses observed Whiteside stumbling around, and at one point he fell over and was assisted by the boy.

After sitting at a table outside McDonald's for a short time, Whiteside and the boy left the parking lot, and he was hit when they attempted to cross the highway to reach their disabled vehicle, police said. Swift said the accident remains under investigation.
