Plaistow lawyer indicted in fatal boat crash
BRENTWOOD — A Plaistow lawyer who allegedly caused a fatal boating crash that killed a 54-year-old Merrimack man last May was indicted on negligent homicide charges.
Lawrence Buswell, 53, of Kingston, is facing a single count of negligent homicide and three counts of second-degree assault for crashing into another boat on Country Pond in Kingston May 26.
The pilot of the other boat, Eric Eskeland, of Merrimack, was killed during the crash.
Buswell faces assault charges for injuring three other passengers in Eskeland's boat, according to indictments.
Prosecutors said Buswell's failure to look out for other boaters led to the fatal crash, which happened at 11:27 p.m.
Buswell was piloting a 20-foot Correct Craft powerboat when he struck the back of Eskeland's Sea Ray, according to indictments.
Buswell's boat drove over the top of the Sea Ray, killing Eskeland and injuring his passengers, according to prosecutors.
All four charges are Class B felonies, each punishable by up to 3½ to 7 years in state prison.
Prosecutors had also filed a misdemeanor vehicle assault charge in the boating case prior to seeking felony indictments.
That charge is punishable by up to a year in county jail and a $2,000 fine.
The indictments mark the second wave of charges against Buswell in Rockingham County Superior Court.
A grand jury indicted him in October on two counts of felonious sexual assault for allegedly forcing a boy to perform two sexual acts while the two were on his boat in July 2011, according to prosecutors.
Buswell had taken the boy swimming on Country Pond and plied him with vodka before assaulting him, indictments say.
Buswell remains free on $50,000 personal recognizance bail in the sexual assault case, and he will be arraigned on the new charges in the boating case later this month in superior court.
As part of his bail conditions, he is prohibited from having contact with any person under 16 years of age.
Buswell has been a New Hampshire lawyer since 1986, according to the state's bar directory.
