Former Derry Town Administrator John Anderson asks judge to dismiss charges

DERRY — An attorney for former town administrator John Anderson is asking that two charges against his client be dismissed.

During a hearing in 10th Circuit Court on Friday, attorney James Rosenberg made the request that the misdemeanor charges of indecent exposure and lewdness be dropped. The decision is now in the hands of Judge Lucinda Sadler.
The case will conclude if the judge dismisses the charges, Rosenberg said on Saturday.
Rosenberg and Rockingham County Attorney Kristen Wilson presented arguments during the hearing.

Anderson, 50, is accused of inviting a DirectTV salesman into his house on July 11 while naked and acting inappropriately.

Rosenberg had argued previously that his client was in the privacy of his own home when the alleged inappropriate conduct occurred and the salesman remained in the home. The salesman, by his own admission, continued to “pitch” the satellite TV product in Anderson’s home, Rosenberg said.
After leaving, the salesman allegedly left behind a brochure for Anderson with his own phone number handwritten on it, Rosenberg said.

Wilson wrote in response to a motion to compel that by entering the home while Anderson was in the nude and staying for a brief period of time, it is unreasonable to argue that the salesman could have invited or enjoyed inappropriate conduct.
Anderson remains free on $2,000 personal recognizance.
