Derry man arraigned in Londonderry home invasion

DERRY — A local man was arraigned Monday in 10th Circuit Court-District Division on charges of breaking into a house in Londonderry on Friday and pointing a gun at a woman who was home with her young son.

Joshua MaGee, 29, was arraigned on charges of burglary, armed robbery, criminal threatening with a dangerous weapon and criminal constraint, a court official said Monday. Bail was set at $50,000 cash. In addition, MaGee was ordered to not have any contact with the victim, the court official said.

At around noon on Friday, Londonderry Officer Randy Duguay responded to Wilson Road for a report of suspicious activity, Duguay said in an affidavit.

Duguay said he learned from dispatch that a caller had reported seeing a man park his car down the street and walk toward the Wilson Road house. The caller heard a woman screaming and then saw a man run from the house. The man had donned a mask and goggles and was wearing Walmart shopping bags on his feet, the caller reported.

A witness described the car as a gray Saturn sedan, according to the affidavit.

The man also had something tucked in his waistband, possibly a gun, the caller said. Duguay said he then went to the house and talked to a 22-year-old woman who told him she was inside the residence with her 1-year-old son when the man entered. The woman said she had come downstairs to check on her son. When she reached the lower floor, she saw her son run around the corner from the kitchen toward her, crying.

When she then went around the corner, she said she saw a man pointing a pistol at her, the affidavit said. The man was tall with a lean build and wearing a black track suit with white stripes and a black hat and dark ski goggles.

The man then asked her, “Where’s the s---?” After telling him there wasn’t anything in the house, the man took the woman and her son into a room and locked them inside. The man then asked for the location for the safe. The woman said she could hear him rummaging around in the house before leaving.

She told Duguay that she checked the house and found only $20 missing. When asked by Duguay if she knew the man, the woman said he reminded her of one of her boyfriend’s friends. Donahue said she knew him only as “MaGee,” the affidavit said.

The woman said the man spoke with a similar accent as MaGee and was about the same height. She added that MaGee had lived with her and her boyfriend and that the gun the man carried was similar to a gun MaGee had, the affidavit said.

As he was finishing speaking to the woman, Duguay said he learned through dispatch that Derry police had stopped the car described by the caller and had the driver in custody for an unrelated drug charge, the affidavit said.

At the time of his arrest in Derry, MaGee was allegedly in possession of a loaded firearm, and clothing and other items described by witnesses, the affidavit said.

MaGee is being held at the Rockingham House of Corrections. His probable cause hearing is scheduled for 10 a.m. on Monday, April 14, at 10th Circuit Court-District Division, according to court officials.
