Lawsuit filed against Pizza Hut franchisees over delivery driver pay

KANSAS CITY — A federal lawsuit has been filed against Capital Pizza Huts Inc., franchisees of nearly 90 Pizza Hut restaurants in seven states, including New Hampshire, for failing to pay minimum wage to their delivery drivers, a law firm said Friday.


“The suit alleges that Capital Pizza is violating federal wage and hour laws by failing to adequately reimburse their drivers for their automobile expenses, resulting in unreimbursed business expenses that reduce pizza delivery drivers’ net wages below minimum wage,” according to a statement from the Missouri law firm of Paul McInnes LLP. The St. Louis law firm of Weinhaus & Potashnick also is involved in the case.The lawsuit is pending in U.S. District Court in Colorado.

Capital Pizza didn’t immediately respond with a comment Friday.The statement said a similar suit is pending against the corporate Pizza Hut stores owned by YUM Brands Inc. in federal court in Colorado. About 6,000 Pizza Hut delivery drivers have joined that case.
